- Bidding and buying on this site is free. Selling however involves fees that may change from time to time or there may be instances in which we offer promotions such as discounted fees. We reserve the right to change these fees with appropriate 5-day notice. Fees are either in USD or Canadian Dollars according to the Seller.s location.
- Online-Auto-Auctions.com is only a venue to host auctions and is not a traditional "auctioneer". As such, we do not exercise control over the truth or accuracy of any item sold and we are not legally liable for any part of the transaction (including payment). We do however have different Assurance programs and services to ensure both the integrity of the process and safeguard you as both a buyer and seller.
- We cannot verify the identities of our members. We have established a user-based feedback forum, which helps you evaluate whether you want to deal with a specific member. Please use it only for that purpose and also consider using our Escrow service even when the item is under $25,000 as it safeguards you as the buyer. If the value of the vehicle being purchased is over $25,000 you MUST use the OAA Escrow service as it protects you from fraud and credit card fraud.
- As a bidder and buyer, remember that you are obligated to complete the transaction. By bidding on our system, you acknowledge that it is a binding agreement that if the successful high bidder you will purchase the item and have the funds necessary to do so. Bids are not retractable save in exceptional circumstances where the seller materially changes the item.s description or a clear typographical error has been made.
- By using this site as an auction venue only, you hereby release online-auto-auctions.com, CDN Location Services Inc and its officers, owners, agents, ancillaries and employees from all claims, demands and damages known and unknown arising out of or in any way connected with using this site and any disputes that arise due to that usage.
- We are not liable for the information provided by members on the site. Please use common sense and caution when dealing when dealing with such information. It may be deceptive and be provided by such people under a false pretense. Please report such behavior as per the guideline outlined in our Reporting Trade Violations.
- In addition, you agree that you will not provide information or images that are:
- False or misleading.
- Fraudulent and involve the sale of stolen items.
- Violate any laws, statutes, ordinances or regulations.
- Defamatory, libelous, threatening or harassing.
- Obscene or contain child pornography.
- Known to contain any known viruses or illegal programming routines meant to damage or cause this site to fail.
- As a user of this site, you also agree not to sell items that are:
- Prohibited under this agreement.
- Identical to other items you have up for auction.
- That are listed on other web sites.
- Not yours, or you do not own.
- By using this site, you shall not:
- Upload any large files to this site that exceeds our picture specifications.
- Copy, reproduce, modify or create works from this site without prior written permission from CDN Location Services Inc.;
- Interfere with the proper working of this site.
- Restrict access to the site.
- As a bidder and buyer on this site you are obligated to complete the transaction when you are the successful highest bidder. Bids are not retractable unless the seller has materially changed the item.s description or a clear typographical error has been made
- As a member on this site, you agree not to take any actions that will undermine the Feedback Forum. If your feedback falls below a .4 (minus 4) rating, you acknowledge that your account may be suspended indefinitely. You also agree not to use your rating or anyone else.s outside this site.
- You acknowledge and agree that we may limit your activities, issue a warning, temporarily or indefinitely suspend your account if you
- breach this agreement;
- Cause others, yourself or us a financial loss.
- You agree that under no circumstances shall we or any of our ancilliary services, officers, employees or suppliers be liable for any losses or damages arising out of or in connection with our site, this service or this agreement.
- You also agree as a user to indemnify and hold us and our ancillaries harmless from any claim, demand and attorney fees made by any third party arising out your breach of this agreement or your violation of any laws or the rights of a third party.
- All Legal Notices shall be sent by email to admin@online-auto-auctions.com. We may give you notices to the address you supplied in your registration with this site and it will be deemed received by you 7 days after mailing.
- In the case of disputes, you further agree to resolve them first by Square Trade, an online alternative dispute resolution service. If that fails, then the dispute will be submitted to an agreed to arbitrator administered by the American Arbitration Association in accordance with their rules.
- If you find that you did not want to list your vehicle, our refund policy is that you must notify refund@online-auto-auctions.com within 24 hrs of listing the vehicle. Otherwise we will remove the vehicle listing but there will be no refund.
